1. Who we are
Anna's Baked Delights.
Anna's Baked Delights is a small bakery operating out of a shared
commercial kitchen at 10th Floor, 10055-106 Street NW, Edmonton, Alberta,
Canada, T5J 2Y2. We bake Thursdays, Fridays, and Saturdays. You can reach
us at hello@annasbakeddelights.com.
Throughout these terms, “we,” “us,” and “our” mean Anna's Baked Delights, and
“you” means the person using the site or placing an order.
2. Agreeing to these terms
By using the site, you accept them.
Browsing, creating an account, or placing an order means you accept these
terms and our Privacy Policy.
You must be at least the age of majority in Alberta (18) to place an order,
or have a parent or guardian do it for you. If we make a material change
to these terms, we'll post the new version here with a new effective date.
Continued use after that counts as acceptance.
3. Accounts
One account, kept honest.
You can browse without an account, but ordering requires one. Use accurate
information, keep your password to yourself, and let us know promptly if
you suspect unauthorized access. You're responsible for anything done
through your account. We may suspend or close accounts that we reasonably
believe are being used to abuse the site, defraud us, or harass other
people, including our staff.
4. Orders, prices, and availability
A small kitchen has small limits.
Prices on the site are in Canadian dollars unless we say otherwise, and
may change without notice. Putting items in your cart doesn't reserve
them; an order is formed only when we confirm it by email or on the
order confirmation page. We may decline or cancel an order for any reasonable reason. If we cancel after you've paid,
you'll get a full refund to the original payment method.
Photographs are illustrative. Bread is a hand-made thing; no two loaves
are exactly alike, and small variation in colour, crumb, and crust is
part of the product, not a defect.
5. Payment
We don't see your card.
Payments are processed by our payment providers, currently PayPal and Stripe.
Card details are entered directly into their forms and never touch our
servers; we only receive a confirmation that the payment succeeded and a
reference identifier. Your use of those services is also governed by their
own terms and privacy policies. We're responsible for fulfilling the order,
they're responsible for processing the payment, and any chargeback or
payment dispute should be raised with us first so we can try to fix it.
6. Pickup and delivery
Pickup is the rule; delivery is the exception.
Most orders are pickup at the kitchen during posted hours. If we've agreed
to delivery for a particular order, you're responsible for giving us
accurate pickup or delivery information. If no one is available to receive
a delivered order at the agreed time, we may leave it at the door at our
discretion or return it to the kitchen, and a second attempt may carry an
additional fee.
7. Cancellations and refunds
Tell us early and we'll work it out.
Because we bake to order and food is perishable, our refund policy is
short and specific:
- Cancelled before we've started. Full refund. Tell us by email at least 48 hours before your pickup time for standard items, or 7 days before for large custom orders.
- Cancelled after we've started. No refund on the portion we've already produced, since we can't resell it.
- Order not picked up. No refund; we'll donate what we can.
- Order is wrong or defective. Tell us within 24 hours of pickup and we'll replace it or refund it. We may ask for a photo and, where reasonable, the uneaten remainder.
Refunds go to the original payment method and typically settle within five
business days, depending on your bank.
8. Allergens and food safety
Our kitchen is not allergen-free.
We bake in a shared commercial kitchen that handles wheat, rye, eggs,
dairy, soy, nuts, and seeds. Even items that don't list a particular
allergen as an ingredient may have been exposed to it through shared
equipment or air. If you have a serious allergy, please contact us before
ordering so we can be honest about whether we can safely accommodate it.
We follow standard food-safety practices, but we can't guarantee a
product is free of any specific allergen.
Bread is best eaten the day it's baked. Once you've taken it home, food
safety is your responsibility.
9. Acceptable use
A short list of don'ts.
When you use the site, please don't:
- Try to break, probe, or overload the site or its underlying services.
- Scrape content, including product descriptions and photos, for commercial use.
- Reverse engineer, copy, or impersonate any part of the site.
- Use the contact form, account system, or order notes to send abuse, threats, hate, or unlawful content.
- Use the site to commit fraud, launder funds, or buy on behalf of someone who's been banned.
We may remove content, cancel orders, or revoke access for any of the above.
10. Our content
The recipes are ours.
The Anna's Baked Delights name, logo, photographs, written content, and
recipes are owned by us or used by us with permission. You may share links
to the site and short quotations with attribution. You may not copy the
site's content into a competing storefront, use our name or logo as your
own, or train a commercial model on our content without written permission.
Stock photography on the site is licensed from third parties and is used
under those licences, not transferred to you.
11. Your content
What you send us, we may use.
If you send us a message, a review, a photo of your order, or any other
content whether through the contact form, email, or social tags you
give us a non-exclusive, royalty-free, worldwide licence to use, display,
and excerpt that content in connection with the bakery. You confirm that
the content is yours to share, doesn't infringe anyone's rights, and
isn't confidential. We won't publish your full name or contact
information without your permission.
12. Third-party services
The site depends on a few other companies.
We use third-party services for hosting, payment processing, email and
SMS, and analytics. Their availability and behaviour are outside our
control. The Privacy Policy lists who they are and what they receive.
Links from our site to other sites are offered for convenience, and we
don't endorse or take responsibility for content on those sites.
13. Disclaimer of warranties
The site is provided as is.
We work hard to keep the site accurate, available, and safe, but to the
fullest extent permitted by law we provide it “as is” and “as available,”
without any implied warranty of merchantability, fitness for a particular
purpose, or non-infringement. We don't warrant that the site will be
uninterrupted, error-free, or free of viruses or other harmful components,
and we don't guarantee that pricing, inventory, or product information
is always perfectly current.
14. Limitation of liability
A small bakery can only carry a small risk.
To the fullest extent permitted by law, our total liability to you for
any claim arising from the site or an order is limited to the amount you
paid us in the 12 months before the claim, or, if you haven't paid us
anything, fifty Canadian dollars. We are not liable for indirect,
incidental, consequential, special, exemplary, or punitive damages, or
for lost profits, lost data, or business interruption, even if we've been
told they were possible. Nothing in these terms limits any right or
remedy you have under Alberta's consumer protection law, and nothing
limits our liability for things the law says we can't limit, like our
own gross negligence, fraud, or wilful misconduct.
15. Indemnification
If you break the rules, the cost is on you.
You agree to indemnify and hold us harmless from any third-party claim,
loss, or expense (including reasonable legal fees) that arises from your
misuse of the site, your breach of these terms, or content you submit.
We'll let you know about any such claim and you can take the lead in
defending it, with our reasonable cooperation; we won't settle a claim
that imposes obligations on you without your consent.
16. Termination
Either of us can end this.
You can stop using the site at any time and close your account by emailing us.
We can suspend or end your access without notice if you break these terms
or for any other reasonable reason. Sections that should reasonably survive
termination, including but not limited to payment, content licences, disclaimers, limitation of
liability, indemnification, and governing law, do survive.
17. Governing law
Alberta law, Alberta courts.
These terms are governed by the laws of the Province of Alberta and the
federal laws of Canada that apply there, without regard to conflict-of-laws
rules. Any dispute that can't be settled informally goes to the courts
of Alberta, and you agree to their jurisdiction. If you're a resident of
another jurisdiction, this clause doesn't take away protections that
your local consumer law gives you that can't be waived.
18. Severability and waiver
If one paragraph fails, the rest stand.
If a court finds part of these terms unenforceable, the rest stays in
force. Our failure to enforce a right on one occasion isn't a waiver of
that right on another. These terms, together with the Privacy Policy and
anything we agree to in writing for a particular order, are the entire
agreement between us about the site.
